Irish Central Bank Fines Coinbase Ireland $3.6 Million for Fund Safeguarding Failures During Banking Crisis

Coinbase Ireland instructed 30 customers to deposit funds into an alternate account during Silvergate's 2023 collapse, violating regulatory protocols designed to protect client assets from institutional failures.

Ireland's Central Bank has imposed a €3.3 million ($3.6 million) fine on Coinbase Ireland Limited for breaching fund safeguarding rules during the March 2023 collapse of crypto-friendly bank Silvergate. The enforcement action, which requires approval from Ireland's High Court, centers on the exchange's handling of customer deposits when one of its banking partners faced imminent failure.

When Silvergate Bank teetered on the brink of collapse in early 2023, Coinbase instructed approximately 30 institutional customers to redirect their deposits into an alternate account held by Coinbase at another U.S. bank. While the move was intended to ensure uninterrupted service, Irish regulators determined it violated protocols designed to segregate and protect client funds from the exchange's own operational risks.

The Central Bank of Ireland cited failures in Coinbase Ireland's oversight and governance systems, specifically its inability to ensure proper safeguarding of customer assets during a moment of banking sector stress. The regulator's concern centers on the principle that client funds should remain isolated from an exchange's corporate operations and protected even if the exchange or its banking partners fail.

Coinbase Ireland has agreed to the facts underlying the enforcement action and will be subject to both fines and ongoing regulatory sanctions once the High Court approves the settlement. The case highlights the tension between crypto firms' need for operational flexibility during banking crises and regulators' insistence on strict client asset protection.

The Silvergate episode unfolded as one of the defining moments of 2023's crypto banking crisis, which also saw the collapse of Signature Bank and Silicon Valley Bank within days. Crypto exchanges worldwide scrambled to move billions in customer deposits away from failing institutions, often under extreme time pressure and with limited regulatory guidance on acceptable procedures.

For ordinary crypto users, the fine underscores a persistent risk: the funds sitting in exchange accounts are subject to the solvency and regulatory compliance of multiple intermediaries, including the exchange itself, its banking partners, and the jurisdictions where each operates. European regulators have been particularly aggressive in enforcing fund segregation rules inherited from traditional financial services.

The enforcement action comes as Ireland positions itself as a key European hub for crypto regulation under the EU's Markets in Crypto-Assets (MiCA) framework, which took full effect in 2024. Coinbase operates its European business through its Irish entity, making the country's regulatory stance critical to the exchange's operations across the continent. The case sets a precedent that operational necessity during a crisis does not exempt firms from safeguarding obligations designed precisely for such moments.
